General Terms & Conditions
1.1 The ngn Internet Platform (hereinafter called the
Website) shall serve to provide general information to users and to establish contacts between companies and single persons (hereinafter called
networkers). ngn – new generation network GmbH is part of the Vogel Communications Group GmbH & Co. KG, including all its affiliated subsidiaries within the meaning of § 15 of the German Stock Corporation Act (AktG) (hereinafter called
2. Information Available
The user shall be able to retrieve two different types of information from the Website:
2.1. Information which companies and networkers have supplied about themselves to ngn and which, in relation to a virtual trade fair, are published on the website – either by ngn or by companies and networkers themselves. This is information from an external source for which ngn shall accept no responsibility.
2.2. Information which may only be accessed by the user by selecting a hyperlink. This information, which is not saved at the website, is information from an external source to which ngn shall merely provide access. On accessing these pages, the user leaves ngn's Internet service.
3. Booking Portal
3.1 It shall only be possible to book a more comprehensive content package via the online booking portal (hereinafter referred to as the
Booking Portal). The Booking Portal displays the options for adding content elements (such as text, logos/ graphics, videos, entries in the calendar of events and space for providing hyperlinks to external content/websites and downloads).
3.2 Steps for concluding the agreement: Authorised users (hereinafter referred to as
subscriber) may select a content package and fill in the information required to book the package. The subscriber may review and, if necessary, correct the information at any time. The registration shall not be binding until the subscriber has clicked on the
Order with obligation to pay button. The agreement shall come into being when ngn either expressly accepts the registration or tacitly accepts the registration by providing the services ordered.
3.3 Receipt of the registration shall be confirmed by email. The receipt of confirmation shall not constitute a declaration of acceptance, however. Ngn shall not be obliged to accept the registration. It hereby reserves the right to reject a registration, e.g. for lack of space; the subscriber shall be notified without delay if his registration is rejected.
4. Rights to the Virtual Trade Fair
4.1 ngn shall have the exclusive right to duplicate, distribute and publicly reproduce the entire Virtual Trade Fair or, depending on type and size, a significant part thereof.
4.2 The user shall not be entitled to any proprietary rights, rights of exploitation or rights of use and enjoyment with reference to the Virtual Trade Fair.
5. Provision of the Service
The information service shall be supplied to the user free of charge. The user shall have no claims to uninterrupted access to ngn's Internet service wholly or in part in this or any other form. ngn shall not be obliged to inform the user of any interruptions.
6.1 Information obtained from an external source and placed on the website on behalf of the companies and/or networkers, shall be the responsibility of ngn only where it has knowledge of this information and where use of this information can be technically and admissibly prevented by ngn. ngn is not aware of any infringement of rights by the information from an external source on its website.
6.2 ngn shall not be responsible for information from an external source to which it merely provides access. This shall apply in particular to information which can be accessed by selecting a hyperlink. The inclusion of a hyperlink on ngn's Website shall be no indication that ngn has verified the contents of the linked website. ngn expressly dissociates itself from the contents of linked websites.
6.3 By submitting or publishing any content on the ngn website, all users guarantee that they are entitled to use such content – this includes in particular any graphic and image files. If, contrary to this assurance, users are not entitled to use such content, they shall indemnify ngn against all claims for damages by third parties.
7. Data Protection
Use of ngn's information service may, if necessary, require the storage of users' data. The processing of users' data shall solely serve to enable utilisation by the user of the information service. You will find detailed information in our data protection declaration.
8.1 Disputes arising from or in connection with this agreement shall be exclusively subject to German law.
8.2 Place of jurisdiction shall, at the election of the plaintiff, either be Berlin-Charlottenburg or the general place of jurisdiction of the defendant.
8.3 Should any provision of this agreement be or become invalid this shall not affect the validity of the remaining provisions of this agreement, which shall remain in full force and effect. In the event of a dispute any invalid provision is to be replaced by the legally effective provision which comes closest to the contents of the invalid provision and which most closely correspond to the parties' economic interests in the invalid provision.
